Under North Carolina law, if the plaintiff’s negligence proximately causes the plaintiff’s injury, the plaintiff is contributorily negligent and cannot recover for his or her injuries or losses. The defendant must prove this contributory negligence on the part of the plaintiff by the greater weight of the evidence. This means that if the plaintiff is even one-percent at fault, even though the defendant may be ninety-nine percent at fault, the plaintiff cannot recover.
