Anytime you are injured because of someone else's negligence, you have the right to be justly compensated for your medical bills, lost wages, and past and future pain and suffering. However, when a driver whose blood alcohol content level is in excess of the state limits caused your injuries, you may also be entitled to damages over and above your actual damages. These damages are known as punitive damages. A jury may award punitive damages to the plaintiff when the defendant acts in a way that indicates a reckless disregard for the health and safety of society as a whole. It has been decided by some courts that driving under the influence of alcohol and drugs is reckless conduct and that someone injured as a result of this conduct is entitled to punitive damages. Check with your attorney to determine if your situation might include an award of punitive damages. If you are injured by a driver whom you suspect is under the influence of alcohol or drugs, you should bring that to the attention of the investigating officer. You have a duty to yourself and others to get that driver off the road.
